'Ordinary Course of Business' Exception, Court Dismisses Lawsuit Against Dental DSO Involving AI Call Recording

The U.S. District Court for the Northern District of Illinois dismissed the lawsuit filed by Megan Lisota against Heartland Dental and RingCentral, based on the "ordinary course of business" exception under the Electronic Communications Privacy Act (ECPA). Lisota alleged her calls were transcribed and analyzed by AI without notification and consent. The court determined that RingCentral's AI functionality was a core service, thus not constituting unlawful interception. Heartland Dental, merely procuring the related services, also bore no ECPA liability. This case is among the first federal rulings involving a Dental Service Organization (DSO) using AI call analysis tools. As of press time, the plaintiff has not announced next steps.

U.S. Federal Court Issues First Ruling on Dental DSO AI Call Recording Case

The U.S. District Court for the Northern District of Illinois procedurally dismissed the lawsuit filed by plaintiff Lisota against Heartland Dental and RingCentral on grounds of "failure to state a claim." The plaintiff alleged that Heartland Dental used AI tools to record calls without patient consent, violating the "two-party consent" provision of the Federal Wiretap Act. Heartland Dental is the largest Dental Service Organization (DSO) in the U.S., supporting over 1,800 affiliated clinics. The court found the plaintiff failed to clearly define the legal roles of Heartland Dental and RingCentral in call processing and did not specify the content of the recorded calls. The plaintiff may amend the complaint and refile. California and Texas have enacted legislation requiring healthcare providers to provide written disclosure when using AI to communicate with patients.

WHO Releases First Global Guideline on Caries Prevention and Management, 8 Recommendations Advocate Mercury-Free Materials as Amalgam Alternatives

On March 3, 2026, the World Health Organization (WHO) released its first global guideline, Environmentally Sustainable and Minimally Invasive Oral Health Care for Caries Prevention and Management, providing 8 evidence-based recommendations and 2 best practice statements covering the complete clinical pathway from caries prevention to restoration. The 8 recommendations include fluoride varnish, silver diamine fluoride, fluoride toothpaste, glass ionomer cement sealants, atraumatic restorative treatment, preventive resin restoration, minimally invasive caries removal techniques, and mercury-free restorative materials. The guideline recommends resin-based composites and glass ionomer cements as alternatives to dental amalgam and notes that materials containing bisphenol A (BPA) have usage limitations for pregnant women and children under 8 years old. WHO plans to host a global launch webinar on March 19, 2026, to formally introduce the guideline.

New Research: PTA-PHMG Coating Achieves Simultaneous Antibacterial and Immune Regulation, May Provide New Design Pathway for Oral Mucosa Repair Materials

A research team from Beijing Stomatological Hospital, Capital Medical University, and Beijing University of Chemical Technology published a study on PTA-PHMG coating in the journal Advanced Functional Materials, proposing a new design pathway for oral mucosa repair materials. In animal experiments, this coating achieved stable adhesion, broad-spectrum antibacterial properties, and macrophage immune regulation. It successfully reduced the expression of pro-inflammatory cytokine mRNA (such as Tnf, Il6) and promoted macrophage transformation towards the anti-inflammatory (M2) type. The study indicated this is related to the activation of signaling pathways like PI3K/Akt. The research is currently still in the animal experiment stage, and the clinical translation pathway requires further study.
